Privacy Policy

Scope

This policy covers the kavarn.com website: browsing it, using its calculators and planner, and contacting us. For that information we decide what is collected and why, and in data protection terms we are the controller.

It does not cover material that customers load into the Kavarn service. That is governed by the agreement between Konvergence and each customer, and nothing in this policy changes it.

Information we collect

Information you give us

You do not need to give us anything to read this site. If you choose to contact us or book a walkthrough, we collect what you submit through the contact form: your name, your firm or practice and your work email address, which are required, and, if you choose to give them, a telephone number, how many matters you have with discovery underway, what you use for eDiscovery today, and anything you want us to know before a call.

The contact form is handled by Netlify, Inc., which also hosts this site. Netlify receives and stores each submission, and a copy is sent by email to the people at Konvergence who respond to inquiries.

Information collected automatically

When your browser requests a page, Netlify, our host, records standard server log information, such as your IP address, the page requested, the time, and your browser type. These logs are used to deliver the site and keep it secure, and are kept for the period Netlify's own policies set.

If you accept analytics cookies, we also use Google Analytics 4 to collect information about your visit: approximate location derived from your IP address, browser type and version, device type and screen size, operating system, the page that referred you, which pages you viewed, in what order, and for how long. Google processes this information on our behalf under its data processing terms. We do not enable Google's advertising features or Google Signals, and we do not use analytics data to identify you. Information from other sources

We do not buy personal information, and we do not use data enrichment or intent-data providers to build profiles of visitors or to identify companies browsing the site.

Information we do not want

Please do not send us case material, client confidences, privileged documents or sensitive personal information through the contact form or by email. It is not the right channel and we are not the right recipient.

How we use what you send us

We use your contact details to respond to the inquiry you made, and for nothing else. We do not add you to a mailing list, we do not put you into an automated email or call sequence, and we do not share your details with anyone outside Konvergence except in the circumstances described under Who we share information with. If we ever offer a newsletter, you will receive it only if you ask to.

Legal bases, for visitors in the UK and EEA

Where we rely on legitimate interests, we have considered whether our interest is overridden by your rights and concluded it is not. You can ask us for our reasoning, and you can object, using the contact details below.

Advertising

We do not use interest-based advertising, we do not run remarketing or retargeting, and we do not share your information with advertising networks.

Aggregated information

We may turn information into aggregate or de-identified form, for example counting how many visitors used a calculator, and use and publish that without restriction. We do not attempt to re-identify anyone from it.

Who we share information with

We do not sell personal information, and we do not share it for cross-context behavioral advertising. We share it only in these circumstances.

• Service providers acting on our instructions: Netlify, Inc., which hosts the site and handles the contact form; Google LLC, for Google Analytics 4; and the providers of our email and business software. Each is bound by contract to use the information only to provide its service to us.
• Professional advisers: lawyers, accountants, auditors and insurers, where they need it and under a duty of confidence.
• Authorities: where we are legally required to disclose, or where disclosure is necessary to protect our rights or the public. We will tell the affected person unless we are prohibited from doing so.
• A buyer or successor: if the business, or the part of it running Kavarn, is sold, merged or reorganized, information may transfer as part of that transaction. Any buyer remains bound by this policy for information collected under it, unless and until you are given notice of a change.

International transfers

Konvergence Inc is based in the United States, and website information is processed in the United States and in other countries where our service providers operate. If you are in the United Kingdom or the EEA, using this site involves a transfer of your information outside your jurisdiction. Where the law requires a transfer mechanism, we rely on one, and you can ask us which applies.

How long we keep it

We keep personal information for as long as we need it for the purpose it was collected for, and then only for as long as the law requires or we need it to defend a claim. We keep contact form submissions for 12 months from the date you send them, and then delete them from Netlify and from our email. When a period ends, we delete the information or de-identify it so it can no longer be linked to you.

Your rights

Wherever you are, you can ask us for a copy of the personal information we hold about you, ask us to correct it, or ask us to delete it, and we will do so unless the law requires us to keep it.

If you are in the UK or the EEA, you also have the right to have processing restricted, to receive a copy in a portable format, and to object to processing carried out on the basis of legitimate interests. Where we rely on consent, you can withdraw it at any time, and withdrawal does not affect anything done before you withdrew. You also have the right to complain to your data protection authority. We would rather you came to us first, but the right is yours either way.

We do not make decisions about you that produce legal or similarly significant effects using automated processing alone.

How to make a request

Email us at the address below and tell us what you want. We will verify who you are before acting, usually by confirming you control the email address we hold, and we will not use anything you give us for verification for any other purpose. We respond within the time the applicable law allows, and we will tell you if we need longer and why. There is no charge.

Security

We use technical and organizational measures appropriate to the risk, including access controls and encryption in transit. No system is completely secure. If we become aware of a breach affecting your personal information, we will notify you and any regulator as the law requires.

Children

This site is aimed at legal professionals. It is not directed at children, we do not knowingly collect personal information from anyone under 16, and if we learn we have, we will delete it.

Changes to this policy

We will post any updated version on this page and change the date at the top. If a change materially affects your rights, we will take additional steps to bring it to your attention. Previous versions are available on request.
